Return Policy for MercuriFashion.com
In accordance with the provisions of the legislation in force in the Republic of San Marino, in particular Law No. 31 of May 10, 1995 “On Consumer Protection” and subsequent amendments, and other legal acts governing distance selling and the terms and conditions of contracts concluded at a distance, this Return Policy is established and approved by the legal entity MERCURI SRL, which owns and operates the online store MercuriFashion.com.
General Return Policy:
1. Return Period:
In accordance with the provisions of Article 16 of Law No. 31 of May 10, 1995 “On Consumer Protection”, the buyer who has concluded a sales contract with MERCURI SRL has the right to return the purchased goods within 14 calendar days from the date of receipt of the order. Returns made after this period will not be considered or processed, except in the cases expressly provided for by the legislation of the Republic of San Marino.
2. Condition of the Goods:
According to article 18 of the aforementioned law, the returned goods must be in proper commercial condition, namely: not worn, not washed, without foreign odors, stains or mechanical damage. All original tags and labels must be intact and the product must be returned in its original undamaged packaging.
Note: MERCURI SRL, in accordance with paragraph 3 of Article 19 of Law No. 31 of May 10, 1995, reserves the right to refuse the return if the item has been used or if it does not meet the above requirements.
3. Exceptions to Returns:
In accordance with Articles 20-22 of Law No. 31 of May 10, 1995, and other legal acts of the Republic of San Marino regulating the conditions of distance selling, the following categories of goods are not subject to return:
- Underwear items, swimwear, jewelry, and cosmetics that cannot be returned due to health and hygiene regulations.
- Customized or personalized items that cannot be returned due to their unique and personalized nature.
- Sale and Final Sale items are non-returnable unless otherwise required by law or stated in the terms of a special promotion.

4. Return Shipping:
In accordance with the internal policy of MERCURI SRL and the provisions of Article 23 of Law No. 31 of May 10, 1995, the buyer is fully responsible for arranging the shipment of returned goods exclusively through the DHL courier service. The use of other courier services is not allowed and will be considered a violation of the return conditions.
The Buyer must arrange for the return shipment, strictly following the instructions provided by DHL. All costs associated with the return shipment, including, but not limited to, packaging, transportation, and insurance, are the responsibility of the Buyer.
5. Refunds:
In accordance with the provisions of articles 25 and 26 of law no. 31 of May 10, 1995, MERCURI SRL undertakes to refund the money to the original method of payment within 14 working days from the date of receipt and thorough inspection of the returned goods for compliance with the above return conditions.
Note: The cost of the initial delivery is non-refundable, except in cases where the goods are received by the buyer in a damaged condition or do not match the description, as confirmed by appropriate evidence.
6. Administrative Return Fee:
In accordance with the right granted by Article 27 of Law No. 31 of May 10, 1995, MERCURI SRL charges an administrative fee of 10 euros for each return, which will be deducted from the refund amount. This fee covers the costs of processing the return and administrative expenses.

Customers are advised to carefully check the size guide provided on the MercuriFashion.com website and contact customer service if necessary before placing an order to ensure the correct size is selected.
Returns due to incorrect size are possible; however, all costs associated with the return and reshipment are the responsibility of the buyer, in accordance with the provisions of Law No. 31 of May 10, 1995 and the provisions of Article 28 regarding the protection of the seller’s rights.
Protection Against Fraudulent Purchases:
8. Right to Refuse Return:
MERCURI SRL, in accordance with the provisions of articles 29 and 30 of law no. 31 of 10 May 1995, reserves the right to refuse to accept a return if it is established that the buyer has abused the rights granted by consumer protection legislation, for example by making multiple returns or returning goods that have been used, damaged or do not comply with the original sales conditions.
9. Inspection of Returned Goods:
All returned goods will be subject to a thorough inspection for compliance with the return conditions specified in this policy and the legislation of the Republic of San Marino. If signs of use, damage or lack of original packaging and labels are detected, no refund will be made. The product will be returned to the buyer at the buyer’s expense in accordance with the provisions of Article 31 of Law No. 31 of May 10, 1995.
